Baby Bubble™ VIP Membership Program — Overview & Terms
- This is a paid, recurring subscription. After any free trial, you will be charged US$29.99 every 30 days, automatically, until you cancel.
- Free trial (if offered): 14 days. If you do not cancel before it ends, billing begins automatically.
- Cancel anytime by emailing support@babbybubble.com. Cancelling stops all future charges. You keep your benefits through the end of the period you have already paid for.
- No refunds for the current period — cancelling ends future billing, not the period you are already in — except as required by the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
- You must be 18 or older to join.
- These Terms set out how disputes between you and Baby Bubble are resolved, including your option to use the Disputes Tribunal of New Zealand (see Section 19).
By enrolling at checkout, you agree to these Terms, which supplement our Website Terms of Service, Privacy Policy, and Refund Policy.
1. About These Terms
The Baby Bubble VIP Membership Program (the "VIP Program") is operated by Baby Bubble ("Baby Bubble," "we," "us," or "our"). These Terms and Conditions (the "Terms") form a legally binding agreement between you ("you," "your," or "member") and Baby Bubble governing your enrolment in and use of the VIP Program.
These Terms supplement, and are in addition to, our general Website Terms of Service, Privacy Policy, and Refund Policy, each of which is incorporated by reference. If there is a conflict between these Terms and the general Website Terms of Service specifically regarding the VIP Program, these Terms control.
Please read these Terms carefully. By clicking to accept, enrolling at checkout, or otherwise using the VIP Program, you acknowledge that you have read, understood, and agree to be bound by them. Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other New Zealand consumer protection law that cannot lawfully be excluded or limited.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to join the VIP Program. We do not knowingly offer memberships to minors. By enrolling, you represent and warrant that you meet these requirements and that all information you provide is accurate.
3. Account and Registration
To participate, you may need to create or maintain an account. You agree to provide complete, accurate, and current information and to keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at support@babbybubble.com of any unauthorised use or suspected security breach. We are not liable for losses arising from your failure to safeguard your account, except to the extent caused by our negligence or breach of these Terms.
4. Acceptable Use and Prohibited Conduct
You agree not to use the VIP Program for any unlawful or abusive purpose, including but not limited to: harassment, fraud, misrepresentation, unauthorised access to systems or accounts, reselling members-only benefits or products, transmitting malware or malicious content, scraping or data harvesting, or interfering with the operation or security of our services. Violation may result in immediate suspension or termination of your membership without refund.
5. Third-Party Links and Services
The VIP Program may reference or link to third-party websites, products, or services. We do not control and are not responsible for third-party content, policies, or practices. Your dealings with third parties are solely between you and them.
6. Privacy
Personal information you submit through the VIP Program is collected, used, and disclosed in accordance with our Privacy Policy and the Privacy Act 2020 (NZ). By enrolling, you consent to that collection and use.
7. Electronic Communications
By enrolling, you consent to receive communications from us electronically, including billing notices, service updates, and required legal notices, by email or by posting on our website, consistent with the Contract and Commercial Law Act 2017 (NZ) and the Electronic Transactions Act 2002 (NZ). You agree that these electronic communications satisfy any legal requirement that such communications be in writing.
8. Membership, Free Trial, and Recurring Billing
Enrolment. You enrol in the VIP Program at checkout. All membership terms are displayed at checkout and must be accepted before your purchase is complete.
Free trial. If a free trial is offered, it lasts 14 days from the date of enrolment. Unless you cancel before the trial ends, your paid membership begins automatically and your payment method will be charged.
Recurring charges (auto-renewal). You authorise Baby Bubble and its payment processors to charge your payment method US$29.99 every 30 days on a recurring basis until you cancel. Each billing cycle renews automatically. You are responsible for keeping a valid payment method on file. If a charge fails, we may retry, suspend, or terminate your membership.
Authorisation. By enrolling, you give ongoing consent to these recurring charges. This authorisation remains in effect until you cancel as described in Section 10.
9. Price Changes
We may change the membership fee or billing frequency. If we do, we will provide reasonable advance notice before the change takes effect (for example, by email or posting on our website). Price changes apply to billing cycles after the notice period. If you do not agree to a new price, you may cancel before it takes effect; continuing your membership means you accept the new price.
10. Cancellation
You may cancel your membership at any time, for any reason, by emailing support@babbybubble.com. Cancellation stops future charges. Your benefits remain active until the end of the billing period you have already paid for, after which they end. Cancelling during a free trial stops any upcoming charge and ends your access at the close of the trial (or immediately, at our discretion).
11. Refunds
Except where required by the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or other applicable New Zealand law, membership fees are non-refundable for the current billing period. Cancelling ends future billing but does not refund the period you are already in. Any refund-related rights are described in our Refund Policy.
12. VIP Program Benefits
As an active member, you receive:
- Up to 80% off select items in the VIP Membership Portal
- Access to exclusive, members-only products
- Early notice on new product drops
- Special discount codes and community rewards
Benefits are available only while your membership is active. We may add, change, limit, or discontinue any benefit at any time without liability, provided we act reasonably. Benefits have no cash value, are non-transferable, and may be subject to availability and additional terms.
13. Orders, Pricing, and Product Availability
We reserve the right to limit quantities, refuse or cancel orders, and correct pricing or descriptive errors, including after an order has been submitted. We may limit or cancel orders that appear to be placed by resellers or dealers, or that we believe violate these Terms. Product descriptions, images, and availability may change without notice.
14. Intellectual Property
The VIP Program, the VIP Membership Portal, and all associated content, including text, graphics, logos, images, product designs, and software, are owned by or licensed to Baby Bubble and are protected by New Zealand and international intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the VIP Program for your personal, non-commercial use while your membership is active. You may not copy, reproduce, distribute, resell, or create derivative works from our content without our prior written permission.
15. Suspension and Termination
We may suspend or terminate your membership, and refuse service to anyone, at any time and for any reasonable cause, including for violation of these Terms, non-payment, or suspected fraud or abuse. We will generally provide notice where practicable, but may act without notice in serious cases. Upon termination, your right to access benefits ends. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will survive.
16. Consumer Guarantees and Disclaimer of Warranties
Nothing in these Terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on you by the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other New Zealand legislation that cannot lawfully be excluded. To the extent permitted by law, and subject to those guarantees, the VIP Program and all products and services are otherwise provided "as is" and "as available," without additional warranties of any kind, whether express or implied. We do not warrant that the VIP Program will be uninterrupted, secure, or error-free, or that benefits, discounts, or products will always be available.
If you are acquiring services under these Terms for the purposes of a business, to the extent permitted by law, the parties agree that the Consumer Guarantees Act 1993 does not apply.
17. Limitation of Liability
Subject to Section 16, and to the maximum extent permitted by law, Baby Bubble and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to the VIP Program or these Terms, even if advised of the possibility of such damages. Our total aggregate liability for any claim relating to the VIP Program will not exceed the total amount you paid to us for the VIP Program in the three (3) months immediately preceding the event giving rise to the claim. Nothing in this section limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot lawfully be limited or excluded under New Zealand law.
18. Indemnification
You agree to indemnify, defend, and hold harmless Baby Bubble and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the VIP Program; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; or (d) any content or information you submit. This indemnity does not apply to the extent a claim arises from Baby Bubble's own breach, negligence, or wilful misconduct.
19. Dispute Resolution
Please read this section carefully — it affects how disputes are resolved.
Informal resolution. Before filing a claim, you agree to first contact us at support@babbybubble.com and attempt to resolve the dispute informally for at least 30 days.
Disputes Tribunal. If a dispute cannot be resolved informally and falls within the relevant monetary jurisdiction, you may bring it before the Disputes Tribunal of New Zealand.
Courts. Any dispute not resolved informally or through the Disputes Tribunal may be brought in the courts of New Zealand as set out in Section 20. Nothing in these Terms requires arbitration or waives any right you have to bring a claim as part of a class, collective, or representative proceeding where New Zealand law gives you that right.
20. Governing Law and Venue
These Terms are governed by the laws of New Zealand. Subject to Section 19, you and Baby Bubble agree that the courts of New Zealand will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the VIP Program, and each party submits to that jurisdiction.
21. Changes to These Terms
We may update these Terms at any time by posting the revised version on our website and updating the "Last updated" date. Material changes will be communicated where required by law. It is your responsibility to review these Terms periodically. Your continued membership after changes take effect constitutes acceptance of the revised Terms, to the extent permitted by law.
22. Force Majeure
We are not liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, labour disputes, supply chain disruptions, internet or utility failures, or government actions.
23. Assignment
You may not assign or transfer these Terms or your membership without our prior written consent. We may assign these Terms freely, including in connection with a merger, acquisition, or sale of assets.
24. Waiver and Severability
Our failure to enforce any provision is not a waiver of that provision. If any provision is found unenforceable, it will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
25. Entire Agreement
These Terms, together with our Website Terms of Service, Privacy Policy, and Refund Policy, constitute the entire agreement between you and Baby Bubble regarding the VIP Program and supersede any prior agreements or understandings on that subject.
